1. Scope and Provider Information

These Terms and Conditions (T&Cs) apply to all orders placed by consumers within the meaning of Section 13 of the German Civil Code (BGB) via our online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (Section 13 BGB).

These T&Cs apply to all orders placed via our online shop at www.supergloops.de and www.supergloops.com.

Divergent or supplementary terms and conditions of the customer shall not apply unless we expressly agree to their validity.

2. Conclusion of Contract and Special Notes on Subscriptions

2.1 Conclusion of Contract

The presentation of products in our online shop does not constitute a legally binding offer but rather a non-binding invitation to submit an order.

By completing the order process and clicking the Buy Now / Order with Obligation to Pay button, you submit a binding offer to conclude a purchase contract.

Before submitting your order, you can review, change, or cancel your entries at any time. During the order process, you will be provided with an overview of your details, which you can review again before placing your order.

The contract is concluded when we send you an order confirmation by email or when we dispatch the goods to you.

2.2 Subscriptions

We offer certain products under a subscription model with regular delivery every 4 weeks.

The contract for the recurring delivery of goods is concluded for an indefinite period. The subscription is automatically renewed for an additional 4 weeks unless it is paused or canceled.

Customers may cancel or pause their subscription at any time without notice. The change applies to future deliveries and must be made at least 3 business days before the next scheduled shipping date.

3. Prices, Shipping, and Payment Terms

3.1 Prices and Shipping Costs

All prices in our online shop are stated in euros and include the statutory value-added tax (VAT).

In addition to the stated product prices, shipping costs may apply. Shipping costs will be clearly communicated to you during the order process before you complete your purchase.

3.2 Payment Methods

We offer you various payment methods. The available payment options will be displayed to you during the order process. These include in particular:

  • Credit card
  • Shop Pay
  • PayPal
  • Klarna
  • Apple Pay
  • Google Pay
  • Other payment methods depending on availability at checkout

Payments are processed through our payment service providers, e.g. Shopify Payments, Klarna, or PayPal. In this case, the terms and conditions of the respective provider also apply.

3.3 Due Date and Time of Payment

The purchase price is due immediately upon conclusion of the contract. For subscriptions, payment is made prior to the dispatch of each delivery, in accordance with the billing cycle.

4. Delivery and Retention of Title

4.1 Delivery

Delivery is made exclusively within Germany. The delivery time is up to 5 business days unless otherwise stated in the product description.

Unless explicitly stated otherwise in the product description, all items offered by us are ready for immediate dispatch.

We reserve the right to offer pre-orders. In such cases, the expected shipping date will be indicated on the respective product page. Shipment will take place as soon as the goods become available.

The risk of accidental loss or accidental deterioration of the sold goods shall not pass to you until the goods have been handed over to you – even in the case of mail-order purchases.

4.2 Retention of Title

The goods remain our property until full payment has been received.

5. Right of Withdrawal

Consumers are generally entitled to a statutory right of withdrawal when concluding a distance selling contract.

Further information on the right of withdrawal can be found in our Withdrawal Policy, which is provided to you during the ordering process and by email.

6. Warranty and Liability

6.1 Warranty

The statutory warranty rights apply.

6.2 Liability

We are fully liable for damages caused by us, our legal representatives, or vicarious agents:

  • in cases of injury to life, body, or health
  • in cases of intentional or grossly negligent breach of duty
  • under guarantees or pursuant to the German Product Liability Act

In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), our liability is limited to the foreseeable damage typical for this type of contract at the time of conclusion.

Any further liability is excluded.

7. Data Protection

We collect, process, and use your personal data exclusively in compliance with the applicable data protection regulations, in particular the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).

8. Contract Language and Storage of the Contract

The languages available for the conclusion of the contract are German and English.

The contract text is not permanently stored by us. Before submitting the order, you can save or print the order data using your browser’s print function. After completing the order, you will receive an order confirmation by email containing the essential order details.

9. Applicable Law and Place of Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence.

For disputes with customers who do not have a general place of jurisdiction in Germany or who are merchants within the meaning of the German Commercial Code (HGB), Munich shall be the exclusive place of jurisdiction.

10. Final Provisions

If individual provisions of these Terms and Conditions are or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.

Exclusively German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, insofar as mandatory consumer protection provisions do not conflict with this.

Collateral agreements and amendments to the contract must be made in text form. This also applies to any modification of this text form requirement.
